This website, including all content on other sites directly linked and created by Be United (collectively referred to in these Terms as the “Website”) is owned and operated by Be United, who is referred to in these Terms as “we”, “us”, “our” and other similar grammatical forms.

The Website may include links to third-party website or social media platforms. These are not controlled by us and are not part of the Website. Your use of any third-party site is governed by that site’s own terms and privacy policies.

These Terms also incorporate additional terms and policies which apply to the use of the Website in our Privacy Policy,which sets out how we use the information you share with us and outline the measures we take to protect such information.

2. Right to Change Terms

2.1 Be United may alter these Terms at any time, in which case the amended Terms will be posted on the Website and will apply from the date of publication. Please check these Terms on each occasion you use the Website. The latest Terms will become binding on you upon your first use of the Website after any amendments and alterations have been implemented. If you do not agree to the revised Terms, you must stop using the Website immediately.

2.2 We occasionally make updates to the Website, including changing the format or content. Please refresh your browser each time you visit any Be United website to ensure that you access the most up to date version.

3. Registration

3.1 You may access and use most parts of the Website without registering your information or details with us.

3.2 Please ensure that the details you provide to us are correct and complete and inform us immediately of any changes to the information that you provided upon registering.

4. Privacy & Use of Aggregate Data

4.1 Be United uses, stores and processes information about you in accordance with our Privacy Policy, and applicable data protection law, which explains: what personal information we collect from you; how and why we collect, store, use and share such information; your rights in relation to your personal information; and how to contact us and the relevant authorities in the event you have a query or complaint about the use of your personal information.

4.2 Where consent is required to process personal data, it will be obtained in accordance with UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

4.3 Personal data may be used for the administration of your membership, communications, delivery of membership benefits, and other activities that support Be United’s mission and operations.

4.4 Be United may use anonymised or aggregated Website and membership data for evaluation, reporting, publicity, and communications. No person will be personally identified without their explicit consent.

5. Use of Website

5.1 Unless otherwise agreed in writing by Be United, you may use material from the Website for personal, non-commercial purposes only. All rights not expressly granted in these Terms are reserved by Be United.   

5.2 Except as permitted under clause 5.3 you may not, without prior written permission from Be United:

a) the reproduction of the material in any material form;

b) the distribution of the material in any material form;

c) re-transmission of the material by any medium of communication;

d) uploading or reposting the material to any other site on the Internet; and

g) “framing” the material on the Website with other material on any other website.

Unauthorised use constitutes a breach of these Terms and may infringe copyright, trademark or other intellectual property rights.

5.3 Subject to these Terms, Be United grants you a limited, non-exclusive, revocable licence to access and view the Website for personal use. This licence does not allow you to distribute, sell, or otherwise commercially exploit any content.

5.4 All content on the Website, including text, images, designs, software, logos, and other materials, is owned by Be United or its licensors and is protected by intellectual property rights.

5.5 You may not modify or copy:

a) the layout, design or functionality of the Website; or

b) copy, reverse engineer, decompile or extract any computer software, data or code contained in the Website.

6.1 The Website may contain links to sites on the Internet owned and operated by third parties  not under our control.

6.2 In relation to the other site on the Internet, which may be linked on the Website, we:

a) provide the links to the other sites as a convenience to you and the existence of a link to other sites does not imply any endorsement by us of the contents of the linked site;

b) are not responsible for the material contained in those linked sites; and

c) cannot guarantee that these links will work all the time and we have no control over the availability of the linked pages.

6.3 If you wish to link from your website to our Website, you may do so only with the express written permission from an authorised person of Be United, and subject to the following conditions:

a) you do not otherwise use any Be United trade marks displayed on our sites without our express written permission;

b) the link must simply consist of either the website address or any linking logo which Be United has authorised;

c) you do not remove, distort or otherwise alter the size or appearance of any Be United logos on the site;

d) you do not in any way imply that we are endorsing any products or services;

e) you do not misrepresent your relationship with us nor present any other false information about us;

f) you do not link from a website that is not owned by you;

g) you must not replicate any page of this Website;

h) you ensure that your website does not contain content that is distasteful, pornographic, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.

6.4 Be United reserves the right to withdraw any permissions made to make website links to our Website at any time and at our complete discretion.

7. Memberships

7.1 Membership Tiers

Be United offers the following membership tiers:

a) Artist Membership – for creatives seeking access to industry-specific training, networking, professional development, and creative opportunities.

b) Individual Membership – for individuals who wish to support our mission and gain access to events, news, and member discounts.

c) Business Membership – for organisations, businesses, and partners who wish to support Be United and collaborate through opportunities, events, or sector-specific engagement.

d) Lifetime Membership – for members who wish to commit to long-term support for Be United. Lifetime Membership is available by arrangement only; individuals wishing to apply must contact Be United at [email protected].

7.2 Membership Fees, Duration and Renewal

7.2.1 Membership is valid for 12 calendar months from the date of acceptance or enrolment and will automatically renew unless cancelled in accordance with these Terms.

7.2.2 Lifetime Memberships are valid indefinitely, subject to these Terms.

7.2.3 Be United reserves the right to introduce or alter fees in connection with its membership fees. Members will be notified at least 30 days’ before any fee changes take effect.

7.2.4 Membership will automatically renew every 12 calendar months unless the member provides notice of cancellation in accordance with clause

7.2.5,  Where notice is received less than 30 days before renewal, Be United reserves the right to process the renewal payment, but may, at its discretion, consider refund requests on a case-by-case basis.

7.3 Membership Benefits and Communications

7.3.1 Core Membership benefits may include:

  • Be United newsletter
  • Access to Be United opportunities
  • Access to industry insights
  • Exclusive member discounts
  • Invitations to relevant events, workshops, or programmes

7.3.2 Be United reserves the right to alter, withdraw or introduce membership benefits at any time and without prior notice. Where reasonably possible, advance notice will be provided.

7.3.3 Individuals who subscribe to the Be United newsletter may be registered as free Members. Membership is optional, and subscribers may opt out at any time.

7.3.4 From time to time, members may be eligible to benefit from reciprocal arrangements with other organisations or business partners that share similar charitable aims, values, or goals. These arrangements are not guaranteed, and any access or benefits are subject to the conditions set by the participating organisations or partners. Members must comply with those conditions in order to benefit from any reciprocal rights.

7.3.5 Membership benefits are delivered primarily via email. Continued subscription to email communications is a fundamental requirement of membership.

7.4 Acceptance, Conduct and Termination

7.4.1 At its discretion, Be United reserves the right to refuse any application for membership.

7.4.2 Be United may suspend or terminate an existing membership if the member:

a) is in breach of these Terms; or

b) engages in conduct contrary to Be United’s values or policies.

7.4.3 Members must act consistently with Be United’s values of equity, empowerment, and excellence. Conduct deemed detrimental to Be United, its mission, staff, volunteers or other members (including harassment, discrimination, or behaviour contrary to these values) may result in suspension or termination of membership.

7.4.4 Be United reserves the right to suspend or terminate any Membership at its discretion. Membership rights and benefits will cease upon suspension or termination. No refunds will be issued except where required by law. Where reasonably possible, notice and reasons for suspension or termination will be provided.

7.4.5 In cases of serious misconduct, suspension or termination may take effect immediately and without prior notice.

7.4.6 For members who are also employees, contractors, or volunteers, Be United may apply relevant organisational policies outlined in staff handbooks or agreements when assessing conduct breaches.

7.4.7 Membership shall terminate automatically on the death of the member. No refunds or compensation shall be provided in the event of a member’s death except where required by law.

7.5 Cancelling Your Membership

7.5.1 Members may cancel their membership at any time by unsubscribing from communications or by contacting Be United directly through our Contact Us page.

7.5.2 Membership is primarily delivered through email communications. By unsubscribing from Be United emails, you acknowledge and agree that this will result in cancellation of your membership and loss of any associated benefits.

7.5.3 To prevent automatic renewal, cancellation requests (including unsubscribing) must be submitted at least 30 days before the renewal date.  Membership rights and benefits will cease upon cancellation. No refunds will be provided except where required by law.

7.6 Gift Membership

7.6.1 Gift Membership may only be used by the named recipient.

7.6.2 The purchaser of a Gift Membership confirm that they have the consent of the recipient to provide their personal data to Be United.

7.7 Non-Transferability

Except in the case of Gift Membership, Membership is personal and may not be transferred or assigned to any other individual or organisation without prior written consent from Be United.

8. Intellectual Property

8.1 All content on this Website including logos, icons, brand names, photographs, footage, designs, images, text, software, data and other material on the Website or generated by the Website are owned by Be United or our licensors (such materials are used with the owners express permissions on this Website) and are protected by UK and international property laws.

8.2 All other trade marks, service marks or logos on this Website are the property of Be United or their respective owners. No rights are granted to use them without express written consent.

8.3 You may access and use content for personal, non-commercial purposes only, provided you do not modify, distribute, commercially exploit or reproduce it without  prior written permission from Be United.  

8.4 Any unauthorised use of the materials appearing on this Website may constitute a breach of these Terms and may lead to criminal or civil legal action under UK law.

9. Advertisers & Sponsors

We may from time to time allow companies to advertise goods and services on the Website. While we will not knowingly run an advertisement or partnership that is untrue, or which relates to goods or services contrary to our mission, the appearance of an advertisement or partnership does not mean that we endorse the advertiser’s or partner’s goods or services. Be United is not responsible for the accuracy of any advertising material or for any advertised product or service.

10. Disclaimers

10.1 To the fullest extent permitted by law, we make no representation, warranty or guarantee that:

a) the Website, or the server that makes the sites available on the Internet are free of software viruses;

b) the functions contained in any software contained on the Website will operate uninterrupted or are error-free;

c) errors and defects on the websites will be corrected; and

d) information and materials provided by Be United will meet your requirements, that it will not infringe the rights of third parties, that it will be compatible with all software and hardware, or that it will be secure.

10.2 We are not liable to you for:

a) errors or omissions on the Website, or linked sites on the Internet;

b) delays to, interruptions of or cessation of the services provided on the Website, or linked sites;

c) defamatory, offensive or illegal conduct of any user of the Website;

d) any loss, disruption or damage to your data or your computer system or any other damages (including amongst other losses, loss of profit or loss of use) arising out of your use or delay or inability to use the Website, its content or any link to another website arising in contract, tort (including negligence), whether caused through our negligence or the negligence of our employees, independent contractors or agents, or through any other cause.

10.3 You agree to accept the full cost of any necessary repair, correction and maintenance of any of your computer software or hardware, which may be necessary because of you accessing the Website.

10.4 We make reasonable efforts to ensure that our material is complete, accurate, and up to date. We do not, however, make any representations, warranties or guarantees (whether express or implied) that our material is complete, accurate, or up to date.

11. Limitation of Liability

11.1 To the fullest extent permitted by law, Be United excludes all conditions, warranties, representations or other terms which may apply to the Website, any content on them, or membership benefits, whether express or implied.

11.2 Liabilities in connection with use of Website

11.2.1 In regards to use of the Website, Be United will not be liable for any loss or damages arising from:

a) any users’ inability to use the Website or their use of any content displayed on the Website;

b) reliance on content, materials or information on the Website;

c) viruses or other harmful material that affects your computer, software, hardware, data or any other relevant property; or

d) any errors, omissions or interruptions in the Website’s services.

11.2.2 This limitation applies except for liability which cannot legally be excluded, including personal injury or death caused by our negligence.

11.3 Liabilities in connection with Memberships and Events

11.3.1 Members participate in productions, events and activities at their own risk. To the fullest extent permitted by law, Be United is not liable for:

a) any loss of profit, revenue or business;

b) any special, indirect, incidental, or consequential losses or damages; or

c) personal injury or damage occurring outside the limits of UK law.

11.3.2 Be United does not limit liability for:

a) death or personal injury caused by our negligence;

b) fraud or fraudulent misrepresentation; or

c) any other liability which cannot be excluded or limited by law.

11.4 No statement or assurance by any staff member, volunteer or representative of Be United shall be understood as varying these Terms unless confirmed in writing by an authorised representative of Be United.

12. Breach of Terms

If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms.

13. Events Beyond Our Control

Be United will not be liable to you for any delay in delivering any services or breach of our obligations, if the delay or breach is due to events beyond our control. Such “force majeure” events may include, but are not limited to:

  • civil commotion;
  • riots;
  • war;
  • insurgence;
  • acts of God;
  • malicious damage;
  • natural disaster;
  • accident;
  • floods;
  • fire;
  • epidemic;
  • failure of internet service or telecommunications provider; or
  • any other cause or event beyond our reasonable control.

This does not affect your statutory rights.

14. Laws & Courts

These Terms and use of the Website are governed by and to be interpreted in accordance with the laws of Scotland. In the event any dispute arises in relation to these Terms and the use of the Website, the courts of Scotland will have jurisdiction over the dispute.
